Last updated: June 10, 2026. By using eCPR Express (the "Service"), you agree to these terms. If you do not agree, do not use the Service.
1. What the Service is (and isn't)
eCPR Express is a document-preparation tool. It formats data you enter into a California DIR eCPR XML file and a U.S. DOL WH-347 PDF, and performs arithmetic on the figures you provide. The Service:
- does not provide legal, tax, accounting, or compliance advice;
- does not determine prevailing wage rates, worker classifications, fringe obligations, or whether your project is subject to prevailing wage law — those come from your wage determination, contract, and professional advisers;
- does not file anything on your behalf — you review, sign, and submit all reports yourself.
2. Beta status
The Service is in beta. It may contain errors, change without notice, or be unavailable at any time. You must independently review every generated report against your own payroll records before signing or submitting it to any agency, prime contractor, or awarding body.
3. Your responsibilities
You are solely responsible for: the accuracy and completeness of the data you enter; verifying every figure, classification, and rate in generated documents; meeting all filing deadlines; and compliance with all applicable laws, including the California Labor Code and the Davis-Bacon and Related Acts. Signing a certified payroll report is your legal certification, not ours.
4. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT GENERATED DOCUMENTS WILL BE ACCEPTED BY ANY AGENCY OR THAT THE SERVICE WILL BE ERROR-FREE.
5. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ECPR EXPRESS OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PENALTIES, FINES, WITHHELD PAYMENTS, LOST PROFITS, OR LOST DATA ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE (ZERO, IF YOU USED ONLY THE FREE SERVICE).
6. Privacy
The Service runs in your browser. Payroll data you enter (names, SSNs, wages, hours) is stored in your browser's local storage and in files you download — it is never transmitted to us. The only data ever transmitted: (a) an email address you voluntarily submit to our founding list (processed by formsubmit.co); (b) on paid plans, your license key, validated by Lemon Squeezy. You are responsible for securing your own device and any backup files you export, which contain unencrypted payroll data.
7. Acceptable use
You may not use the Service to prepare documents you know to be false or misleading. Falsifying certified payroll records is a crime under state and federal law.
8. Changes
We may update these terms; the "Last updated" date will change and continued use constitutes acceptance. Material changes for paying customers will be notified by email.
